MINEOLA, N.Y. — A New York judge has awarded an insurer summary judgment on a claim asserting violations of New York General Business Law Section 349, finding the plaintiffs failed to detail their allegation of the insurer’s alleged pattern and practice to deny claims after significant perils such as Superstorm Sandy.
Judge Leonard Steinman of the Nassau County Supreme Court also denied the plaintiffs’ motion for summary judgment on their claims, ruling that a question of fact exists as to whether their flood damage was caused by an internal plumbing leak or Superstorm Sandy.
