TRENTON, N.J. — A New Jersey federal judge has denied a warehouse owner’s motion for summary judgment in an action filed by a spice company and its insurer seeking compensation for Superstorm Sandy-related spoilage to product stored in the defendant’s warehouse.
In a March 22 order, Judge Jose Linares of the U.S. District Court for the District of New Jersey said a disputed issue of material fact exists as to whether the operative warehouse receipts stated that such actions must be filed nine months after learning of the damage to the stored product.
