N.Y. Federal Judge Dismisses Superstorm Sandy Coverage Actions for Failure to Prosecute

NEW YORK — A New York federal judge has dismissed two Superstorm Sandy coverage cases for failure to prosecute, adopting a magistrate judge’s findings that the plaintiffs failed to properly serve the defendant insurers.
On March 15, Judge Leonard D. Wexler of the U.S. District Court for the Eastern District of New York noted that neither plaintiff objected to the magistrate judge’s findings, and, as such, his report and recommendation should be adopted.
In these two cases, Mary Nogueira and Larry Sperber each sought coverage from their respective insurers, Travelers Casualty Co. and American Security Insurance Co., for Superstorm …
