N.J. Federal Judge Allows Plaintiff to Submit Evidence of Attorney Misconduct in Sandy Coverage Action

CAMDEN, N.J. — A New Jersey federal judge has allowed a plaintiff to present evidence demonstrating that her former counsel’s conduct, which resulted in dismissal of her Superstorm Sandy coverage case, was “so gross that it is inexcusable.”
On Feb. 16, Judge Noel L. Hillman of the U.S. District Court for the District of New Jersey dismissed the plaintiff’s motion to set aside the order terminating her case, but did so without prejudice, noting that the evidence is insufficient as to whether her lawyers had her case dismissed without her approval or knowledge.
