La. Judge Refuses to Remand Hurricane Isaac Coverage Case, Says Jurisdictional Minimum Exceeded

NEW ORLEANS — A Louisiana federal judge has denied a plaintiff’s second request to remand a Hurricane Isaac coverage case, ruling that the plaintiff failed to show that the amount in controversy was less than $75,000 at the time of removal.
On Dec. 30, Judge Nannette J. Brown of the U.S. District Court for the Eastern District of Louisiana further rejected the plaintiff’s argument that remand is appropriate due to “newly discovered” evidence regarding the sum at issue, noting that such evidence could have been uncovered with due diligence.
