TRENTON, N.J. — A condominium association seeking recoupment from Lexington Insurance Co. for the full amount of its Superstorm Sandy claim is urging a New Jersey federal judge to allow it to assert a Consumer Fraud Act claim, arguing that it has pled the count with the required specificity.
In its Sept. 16 brief filed in the U.S. District Court for the District of New Jersey, the association further asserts that Lexington would not suffer prejudice if its proposed amended complaint is permitted.
