N.J. Federal Judge Dismisses Consumer Fraud Act Claim in Sandy Coverage Action

NEWARK, N.J. — A New Jersey federal judge has dismissed a New Jersey Consumer Fraud Act claim asserted against an insurer in a Superstorm Sandy case, ruling that the plaintiff failed to adequately allege a claim for fraud.

On Sept. 29, Chief Judge Jerome B. Simandle of the U.S. District Court for the District of New Jersey ruled that the complaint contains no allegations that the insurer made false statements about the policy leading the plaintiff to believe that the repairs or services the insurer denied were included in the plaintiff’s coverage when he bought the policy.
