GREENVILLE, Miss. — A Mississippi federal judge has remanded for the second time a lawsuit brought against a “Write Your Own” insurer accused of misrepresenting the policy’s scope of coverage, ruling that no federal question claim has been pled on the face of the amended complaint.
In a Sept. 15 order, Senior Judge Neal B. Biggers Jr. of the U.S. District Court for the Northern District of Mississippi further held that the plaintiff’s deposition statement that they are seeking $100,000 in damages does not constitute an attempt to evade federal jurisdiction by artfully pleading the complaint.
