NEWARK, N.J. — A New Jersey federal magistrate judge has denied a policyholder’s motion to extend discovery in a Superstorm Sandy coverage case in order to back his newly asserted claim for complete rebuilding of his property, finding the insurer would be prejudiced by such an extension.
In a Sept. 3 order, Magistrate Judge Douglas E. Arpert of the U.S. District Court for the District of New Jersey noted that all of the insurer’s discovery was taken without the benefit of knowing that the policyholder was claiming damages for rebuilding the property, and the new damages claim would require reopening …
