N.Y. State Judge Extends Time Limit for Service of Superstorm Sandy Coverage Complaint

MINEOLA, N.Y. — Based upon an “interest of justice,” a state judge has extended New York’s 120-day time period for service of a Superstorm Sandy coverage complaint, finding the plaintiff’s cause of action is potentially meritorious.
On Aug. 19, Judge George R. Peck of the Nassau County Supreme Court further noted that the plaintiff had attempted service at least twice before the period’s expiration and that the insurer will not be prejudiced by an extension.
