WHITE PLAINS, N.Y. — Damage to a home caused by the migration of a wooden dock from a neighboring property during Superstorm Sandy is excluded from coverage because it was caused by water, rather than wind, a New York federal judge has ruled.
On Aug. 7, Judge Nelson S. Roman of the U.S. District Court for the Southern District of New York rejected the insured’s assertion that the damage is covered because the dock was blown into the house. There is no question that water was involved in the dock’s movement, the judge explained.
