NEW YORK — A judge has refused to disqualify plaintiffs’ counsel in a Superstorm Sandy coverage action, ruling that although the lawyer worked for the defense counsel’s firm in the past and represented the defendant insurer’s affiliates, there is no evidence that he had access to privileged information that he could use against the insurer in the instant action.
On July 30, Judge Margo K. Brodie of the U.S. District Court for the Eastern District of New York held the insurer “failed to meet the high burden required to warrant the drastic remedy of disqualification.”
