NEW YORK — A New York judge has quashed an insurer’s subpoena seeking information related to a plaintiff’s expert’s inspection of a property that was allegedly damaged by Superstorm Sandy, ruling that the insurer had a “full and fair opportunity” to inspect the premises before they were demolished.
On May 6, Justice David Elliot of the Queens County Supreme Court found the insurer failed to make a showing of special circumstances that would have entitled it to the expert’s expected testimony.
