Louisiana Court Denies Insurer’s Motion to Dismiss Hurricane Isaac-Related Dispute, Allows Plaintiff Leave to Amend

NEW ORLEANS –– A Louisiana federal court has denied an insurer’s motion to dismiss an insurance action involving damage from Hurricane Isaac, but opined that the plaintiff was required to plead the $75,000 jurisdictional amount for each name or member.
In the May 21 opinion, the U.S. District Court for the Eastern District of Louisiana also concluded that the plaintiff had failed to establish that the parties in the action are diverse.
However, the federal court did allow the plaintiffs 21 days to amend its complaint in order to satisfy the requirements of diversity jurisdiction.
