CENTRAL ISLIP, N.Y. — A New York judge has dismissed a lawsuit filed against Interboro Insurance Co. by a homeowner who alleged that his residence was rendered uninhabitable by mold after being damaged by Superstorm Sandy.
In an order entered March 23, Suffolk County Supreme Court Justice Joseph A. Santorelli ruled that plaintiff Harvey Ziontz failed to file the complaint within the timeframe required under the terms of his insurance policy.
Ziontz sued Interboro on Nov. 25, 2014, accusing the insurer of wrongfully denying his Superstorm Sandy claim. According to the lawsuit, Ziontz’s residence became “covered” in mold as a …
