N.J. Federal Judge Sets Aside Default Judgment Against Insurer in Sandy Coverage Case

NEWARK, N.J. — A New Jersey federal judge has granted Liberty Mutual Insurance’s motion to set aside a default judgment in a Superstorm Sandy coverage case, finding the insurer did not willfully miss a deadline to respond to the plaintiffs’ complaint.
In an April 1 order, Senior Judge Williams H. Walls of the U.S. District Court for the District of New Jersey concluded that the insurer’s miscalculation of the deadline was inadvertent and allowing the case to proceed will not prejudice the plaintiffs.
