N.Y. Court Throws Out Misrepresentation Claims in Superstorm Sandy-Related Insurance Dispute

MINEOLA, N.Y. –– A New York trial court has dismissed three of four claims brought in a Superstorm Sandy-related insurance dispute, finding in part that the plaintiff had failed to allege facts that would support negligent and/or intentional misrepresentation claims.
In the Feb. 24 ruling, the New York Supreme Court for Nassau County further opined that another one of the plaintiff’s claims against the insurer was duplicative.
The underlying claims involve alleged property damage that occurred at plaintiff Masimba Mutema’s residence in the wake of Superstorm Sandy. The property was insured under a residential insurance policy issued by New York …
