NEWARK, N.J. — A New Jersey woman seeking coverage for losses caused by Superstorm Sandy may amend her lawsuit to add a second insurer defendant that was mistakenly left off her original complaint, a federal judge has ruled.
In a Jan. 28 decision, Judge James B. Clark III of the U.S. District Court for the District of New Jersey ruled that because there is an “identity of interest” between the two insurers, the amendment adding the second relates back to the original pleading and will not be impacted by the statute of limitations, which had expired by the time the …
