NEWARK, N.J. — A federal judge has refused to extend a deadline for serving defendants in a Superstorm Sandy flood lawsuit after it was determined that plaintiff’s counsel misled the court by filing a false affidavit of service to avoid dismissal based on a previously imposed deadline.
In an order dismissing the case, Judge Jerome B. Simandle of the U.S. District Court for the District of New Jersey commented that counsel’s conduct in filing the affidavit despite knowing that service was not effected amounts to more than mere inadvertence.
