N.J. Judge Refuses to Revisit Decision to Apply Named Storm Deductible to Superstorm Sandy Insurance Claim

NEW BRUNSWICK, N.J. — A New Jersey trial court judge has refused to reconsider his decision that a named storm deductible be applied to nearly $50 million in Superstorm Sandy-related losses sustained by a supermarket buying co-operative.
In a Jan. 23 decision, Middlesex County Superior Court Judge Travis L. Francis ruled that although some of the co-op’s claimed damage may have occurred when Sandy was no longer a hurricane, language in the co-op’s policy did not necessarily require that the storm be “named” in order for the Named Storm Deductible to apply.
