NEW ORLEANS — An issue of fact exists as to whether a lawsuit demanding coverage for Hurricane Isaac property damage was timely, because it is not clear whether the insurer’s denial of coverage was based on a claim that included the policyholder’s sworn proof of loss, a Louisiana federal judge has ruled.
In a Jan. 22 order, Judge Ivan L.R. Lemelle of the U.S. District Court for the Eastern District of Louisiana further found that a question of fact exists as to whether the policyholder submitted adequate documentation to support her SFIP claim.
