N.Y. Judge Rules Against Insurer in Fight over Cancellation of Flood Coverage Ahead of Superstorm Sandy

MINEOLA, N.Y. — An auction house that was denied coverage for flood damage caused by Superstorm Sandy was awarded judgment in New York after a state court judge ruled that its insurer improperly removed a flood provision from its policy prior to denying the claim.
Nassau County Justice Denis L. Sher said in a Jan. 6 decision, which also denied a motion for summary judgment filed by Hanover Insurance Co., that the insurer failed to meet statutory requirements for providing its insured with notice that the flood coverage was being canceled.
