NEW BRUNSWICK, N.J. — A commercial property insurer has been awarded summary judgment on several issues in a dispute over coverage of $50 million in Superstorm Sandy damage claimed by a buying cooperative for Shoprite and PriceRite supermarkets.
In an Oct. 29 decision, Judge Travis L. Francis of the Middlesex County Superior Court sided with insurer Lexington Insurance Co. in determining that payment for the damage is subject to a Named Storm deductible, which is to be calculated based on the stated value of the property where the loss occurred.
