N.J. Court Channels Pink Floyd, Dismisses Superstorm Sandy Insurance Suit

TRENTON, N.J. — A plaintiff’s repeated pattern of non-compliance with a New Jersey court’s discovery orders has led to the outright dismissal of his Superstorm Sandy insurance coverage case.
In an Oct. 28 order, Judge Joel A. Pisano of the U.S. District Court for the District of New Jersey adopted the recommendation of Magistrate Judge Tonianne J. Bongiovanni, who recited lyrics from Pink Floyd’s Comfortably Numb in urging dismissal of the case with prejudice. The order also permits defendant Narragansett Bay Insurance to recover from plaintiff’s counsel any expenses, including attorneys’ fees, in connection with the matter.
