NEWARK, N.J. — A New Jersey judge has adopted a recommendation to dismiss a Superstorm Sandy coverage action against Farm Family Casualty Insurance Co., agreeing that the case is “impossible to adjudicate” without the plaintiff’s submission of a proof of loss detailing his damages.
In an order entered Oct. 27, Judge Jose L. Linares of the U.S. District Court for the District of New Jersey agreed that sua sponte dismissal of the lawsuit was proper given the plaintiffs’ “protracted and ongoing failure” to prosecute the matter.
