TRENTON, N.J. — A federal judge in New Jersey has signed off on the outright dismissal of a Superstorm Sandy insurance coverage case after the plaintiff failed to comply with a requirement that he appear at a court-ordered deposition.
Judge Joel A. Pisano’s Oct. 27 decision to adopt the report and recommendation of Magistrate Judge Tonianne J. Bongiovanni results in the dismissal with prejudice of claims asserted against FEMA and American Bankers Insurance Co. for their alleged refusal to cover a Sandy-related flood claim.
