LOS ANGELES — A federal judge in California has entered a judgment for more than $1.9 million against Lexington Insurance Co. after a jury determined that the insurer wrongfully applied a named storm deductible to a Superstorm Sandy flood claim filed by its New York insured.
Judge Beverly Reid O’Connell issued the judgment Sept. 26, one week after the eight-person jury in the U.S. District Court for the Central District of California awarded approximately $1.6 million in damages and attorneys’ fees stemming from the coverage dispute. The remainder of Judge O’Connell’s judgment included prejudgment interest of almost $300,000.
