NEW YORK — A federal judge in New York has returned a Superstorm Sandy insurance coverage action to state court and awarded the plaintiff attorney’s fees after determining that the insurer defendant improperly removed the case to federal court.
Judge Pamela K. Chen of the U.S. District Court for the Eastern District of New York said in the Sept. 23 decision that there was no objectively reasonable presumption on the part of Narragansett Bay Insurance Co. that the plaintiff’s claim for damage caused by sewer backup would meet the $75,000 requirement for federal jurisdiction.
