NEW YORK — A New York federal judge has dismissed an insurer’s claims against a freight forwarder seeking contribution for more than $75,000 in cargo damage caused by Hurricane Sandy, finding they are not factually supported.
In a Sept. 16 order, Judge Ronnie Abrams of the U.S. District Court for the Southern District of New York ruled that Allianz Corporate Global and Specialty failed to sufficiently allege that the defendant assumed the degree of responsibility for the cargo that the insurer’s negligence claim demands.
