Insurer Seeks Dismissal of Superstorm Sandy Flood Coverage Lawsuit Based on 30-Day Waiting Period

TRENTON, N.J. — An insurer sued for denying a Superstorm Sandy flood claim has moved to dismiss the complaint, arguing that the losses for which the plaintiff sought coverage occurred prior to the mandatory 30-day waiting period for new Standard Flood Insurance Policies.

According to an Aug. 8 motion filed in U.S. District Court for the District of New Jersey, Selective Insurance Co. of America argues that the case must be dismissed because the policy at issue had not been paid for and was not in effect at the time Sandy caused damage to plaintiff’s property.
