PHILADELPHIA — A Pennsylvania couple who sued State Farm Fire and Casualty Co. for damage caused to their home during Superstorm Sandy can proceed with breach of contract and a portion of their bad faith claims asserted against the insurer, a federal judge has ruled.
Judge Robert F. Kelly of the U.S. District Court for the Eastern District of Pennsylvania said in an Aug. 19 decision that there are conflicting expert opinions about whether a tree that crashed through the roof of the couple’s home during Sandy caused additional damage to hardwood floors in the residence.
