N.Y. Judge Dismisses Suit Against Bank That Allegedly Ignored Request to Endorse Superstorm Sandy Insurance Check

MINEOLA, N.Y. — A New York judge has granted a mortgage holder’s motion to dismiss a complaint alleging that the bank violated state consumer protection laws and acted in bad faith when it ignored requests to endorse an insurance check issued to a couple for damage caused by Superstorm Sandy.
Justice Denise L. Sher of the Nassau County Supreme Court ruled June 26 that the plaintiffs’ complaint failed to allege a prima facie violation of New York Business Law § 349, which required a showing that the Citimortgage Inc.’s conduct in refusing to endorse the check was “consumer-oriented” and done …
