N.Y. Judges Urged to Dismiss State Law, Damages Claims from Superstorm Sandy Suits

NEW YORK — Magistrate judges assigned to manage more than 1,000 Superstorm Sandy insurance coverage lawsuits have recommended that the nearly two-dozen judges presiding over the cases dismiss state law claims alleged in the complaints, including those seeking damages that are unavailable under New York law.
In a report and recommendation issued June 5, the three magistrate judges in the U.S. District Court for the Eastern District of New York said the claims are among those the court already directed counsel to dismiss earlier this year after several judges pared similar causes of action from Sandy-related lawsuits.
