MINEOLA, N.Y. — A New York judge has dismissed all but a breach of contract claim asserted in a lawsuit against New York Property Insurance Underwriting Association seeking complete coverage of windstorm damage caused by Superstorm Sandy.
In a May 21 decision, Nassau County Supreme Court Justice Thomas Feinman also refused to grant the plaintiff’s cross-motion for leave to amend her complaint to amplify allegations supporting claims for extra-contractual damages against the insurer.
