NEWARK, N.J. — A claims adjuster named as a defendant in a Superstorm Sandy insurance coverage case has asked a federal judge to rule in its favor on accusations that a representative of the company was trespassing when he was sent to evaluate the plaintiff’s damage claim.
CNC Catastrophe & National Claims moved for judgment on the pleadings May 19 in U.S. District Court for the District of New Jersey, arguing that the claims of common law trespass are “doomed to failure” because they fail to allege any damage caused by the adjuster’s entry into the plaintiff’s home.
