Bad Faith Claims Dismissed from County’s Lawsuit Over Coverage of Hurricane Damage

NEW YORK — The Travelers Indemnity Co. cannot be sued in New York for bad faith after refusing to cover Hurricane-related damage to four properties owned by Orange County, a federal judge has ruled.
Judge Nelson S. Roman of the U.S. District Court for the Southern District of New York said in a May 14 opinion that the bad faith count asserted in the lawsuit must be dismissed, even though the insurer waited more than a year before providing a reason for denying the claim, which it allegedly did without investigating the damage.
