N.Y. Judge Dismisses Bad Faith, Punitive Damages Claim from Superstorm Sandy Insurance Suit

MINEOLA, N.Y. — Claims for bad faith and punitive damages have been dismissed from a Superstorm Sandy insurance coverage case after a New York state court judge ruled that they are duplicative of breach of contract allegations asserted in the complaint.
Justice Robert A. Bruno of the Nassau County Supreme Court rejected the claims in a May 13 decision that also disposed of allegations that Public Service Mutual Insurance Co. violated New York General Business law when it refused to cover catastrophic damage to a motor lodge that was caused by Sandy.
