NEW YORK — A coverage lawsuit over damage caused by Superstorm Sandy has been sent back to state court after a judge in New York ruled that a credit union named as a defendant in the case never consented to removal to federal court.
Judge Sandra J. Feuerstein of the U.S. District Court for the Eastern District of New York said in the May 1 decision that Allstate Insurance Co.’s failure to obtain permission from BethPage FCU rendered the insurer’s petition to remove the case untimely, as the deadline for properly sending the case to federal court has expired.
