MINEOLA, N.Y. — An insurer that provided coverage to a New York restaurant damaged by Superstorm Sandy has challenged a subpoena issued recently in a lawsuit the eatery filed against its broker for misrepresenting that it was covered in the event of a flood loss.
Utica First Insurance Co. moved April 9 to quash the subpoena, arguing that it has not been named a defendant in the lawsuit and that information sought from the insurer’s claims file is irrelevant to the case.
