TRENTON, N.J. — A commercial lines insurance carrier that was sued by a New Jersey emergency squad over coverage of a Superstorm Sandy flood claim has moved to dismiss allegations that it violated the National Flood Insurance Act.
In its April 14 motion filed in U.S. District Court for the District of New Jersey, Arch Insurance Co. contends that it cannot be sued under the Act because it never provided flood insurance to the plaintiff and does not participate in the National Flood Insurance Program.
