NEW YORK — A New York building owner is appealing a recent state court decision dismissing allegations of bad faith against an insurer that refused to pay its portion of a Superstorm Sandy property damage claim.
In a notice filed March 25 in the New York Supreme Court’s Appellate Division, First Department, Orient Overseas Associates says the court erred when it found no basis in New York state law for separate bad faith claims handling allegations against the insurer and that they were duplicative of a complaint’s breach of contract claim.
