NEW YORK — Judges overseeing Superstorm Sandy litigation in New York federal court have rejected an attempt by insurers to amend a recently issued case management order they say prevents defendants from conducting formal discovery in the cases.
In a new CMO filed April 7, the three-judge panel assigned to nearly 1,000 Sandy-related flood insurance suits in U.S. District Court for the Eastern District of New York said the current discovery plan does nothing to deny any party’s rights to conduct discovery.
