N.Y. Judge Orders Counsel to Continue Representing Lloyd’s of London Insured in Superstorm Sandy Suit

MINEOLA, N.Y. — A New York judge has rejected defense efforts to allow their insurer-appointed counsel to withdraw from a case involving property damage caused by an oil tank that was dislodged during Superstorm Sandy.

In a decision entered April 2, Nassau County Supreme Court Justice Jerome C. Murphy said counsel must continue representing the defendants and ordered Lloyd’s of London to pay the firm’s fees and expenses, despite the insurer’s refusal to cover the damage claim based on a pollution exclusion in the defendant’s homeowner’s policy.
