Plaintiff Can Depose Insurance Investigator in Superstorm Sandy Coverage Case, N.Y. Judge Rules

NEW YORK — A state court judge in New York has permitted plaintiffs in a Superstorm Sandy coverage case to depose an investigator hired by their insurance carrier to inspect damage the insurer eventually refused to cover.
In a March 11 order, New York County Supreme Court Justice Joan A. Madden denied a motion by New York Property Insurance Underwriting to quash a subpoena to take the deposition, ruling that it was properly ordered because the investigator’s inspection occurred prior to the denial of coverage and before the plaintiffs filed suit.
