NEW YORK — A federal judge in New York has awarded summary judgment to Allstate Insurance Co. after determining that an insured waited too long to submit evidence of a supplemental claim for hurricane-related flood damage.
U.S. District Judge Sandra Feuerstein of the Eastern District of New York ruled March 6 that the $204,000 proof of loss for foundation and flooring system damage that was submitted six months after FEMA’s extended deadline for filing such claims violated terms of the Standard Flood Insurance Policy (SFIP) covering the property.
