NEW YORK — A diner that sustained more than $150,000 in food spoliation expenses and business income losses after Superstorm Sandy has sued its insurer and Consolidated Edison Company of New York, blaming the utility for a substation explosion that left the eatery without electricity for several days.
In a complaint filed Jan. 23 in New York County Supreme Court, 109 West 14th Street Inc. says National Specialty Insurance Co. wrongfully denied its Sandy claim after categorizing the loss as flood-related, when it was reported that the ConEd explosion was caused by wind.
