Plaintiffs Denied Bid to Take First Depositions in Superstorm Sandy Insurance Case

MINEOLA, N.Y. — A New York judge has refused to give priority of depositions to members of a condominium association who accused their insurance agent of neglecting to communicate a nearly $30 million reduction in coverage that went into effect one month before Superstorm Sandy.
Nassau County Supreme Court Justice Timothy S. Driscoll said in a decision released Jan. 27 that plaintiff Lido Beach Towers and its board failed to present any special circumstances warranting a deviation from traditional priority, which he said was preserved when defendants served deposition notices upon answering the complaint.
