NEW YORK — A federal judge has dismissed a New York couple’s lawsuit against the Federal Emergency Management Agency after determining that they failed to submit sufficient evidence of proofs of loss supporting their claim for more than $70,000 in tropical storm-related flood damages.
Judge Leonard D. Wexler of the U.S. District Court for the Eastern District of New York ruled Dec. 19 that because plaintiffs Alfred and Christine DeStefanis neglected to submit a proof of loss for the amount of damages sought in their complaint, he lacks jurisdiction to preside over the claim.
