NEWARK, N.J. — A New Jersey couple has sued State Farm Fire and Casualty Co. for refusing to pay for anything other than its own repair plan for the couple’s $300,000 Spanish-style tile roof that was damaged during Superstorm Sandy.
The complaint, filed in Essex County Superior Court and removed recently to federal court, alleges that State Farm breached its contract with the insured homeowners by insisting that the roof be repaired by harvesting undamaged tiles from the rear slope of the roof and moving them to the front.
