NEW YORK — A commercial building owner in New York City has sued Seneca Insurance Co. after it denied coverage for Superstorm Sandy wind damage months after the policy was canceled for allegedly failing to comply with loss control recommendations made by the insurer.
In a lawsuit filed in New York County Supreme Court, Swotel Holdings seeks a declaration of coverage based on a contention that it never received adequate notice from Seneca that the policy had been canceled and because the insurer failed to state a valid reason under New York law for voiding the policy.
